What the record shows
WCVB reports, updated 9:12 AM EDT Sep 3, 2026: "Jurors in the trial of Lindsay Clancy, the Massachusetts mother accused of strangling her three children in 2023, will continue deliberations Thursday after they twice told the judge that they are deadlocked."1 WCVB reports: jurors first reported deadlocked Tuesday morning, judge asked them to keep working; after about five hours Wednesday, group sent another note reporting still stuck.1 WCVB reports Judge William Sullivan presented the Tuey-Rodriguez instruction, sometimes known as the "dynamite charge," which urges them to keep working and suggests there is no reason to believe a different jury would have an easier time reaching agreement.1
Boston 25 reports, September 03, 2026 at 6:35 am EDT: "The jury in the Lindsay Clancy murder trial returns to court Thursday morning for what could be its final day of deliberations after twice telling the judge it remains unable to reach a unanimous verdict."2 Boston 25 reports: "roughly 30 hours over five days" reviewing evidence and testimony.2 Boston 25 reports: Wednesday afternoon, jury informed Sullivan for a second time deadlocked and unable to agree; rather than declaring mistrial, Sullivan delivered Tuey-Rodriguez instruction.2
Boston 25 reports Sullivan quote from Wednesday instruction: "There is no reason to suppose that the case will ever be submitted to 12 persons more intelligent, more impartial, or more competent to decide it, that more or clearer evidence will be produced," … "And with this in mind, it's your duty to decide the case, if you can do it conscientiously."2 Boston 25 reports: "The instruction encourages jurors to continue discussing the case, carefully consider one another's views, and make every reasonable effort to reach a unanimous verdict without abandoning sincerely held beliefs."2
Boston Globe reports, 3 Sep 2026: "Jurors are continuing to deliberate the fate of Lindsay Clancy, the Duxbury woman charged with murder in the deaths of her three children in January 2023, after informing the judge twice in two days that they have been unable to reach a unanimous verdict."3 Globe reports: on both Tuesday and Wednesday, jury told Judge William Sullivan could not reach consensus; he urged them to continue trying, and Wednesday gave them Tuey-Rodriguez charge, also known as "dynamite charge," which effectively tells jurors there's no other group better able to reach verdict.3 Globe reports: "So far, they have deliberated for about 30 hours over five days."3
Boston Globe reports 9:10 a.m. Travis Andersen: "Judge William Sullivan got on the bench at 9:10 a.m. and greeted the parties before calling in the jury."3
Boston Globe reports 9:13 a.m. Travis Andersen: Judge William Sullivan sent jurors out to continue deliberating. "I'm going to ask you to resume your deliberations," he said. "Thank you."3
Second deadlock note, Tuey-Rodriguez charge, and Wednesday afternoon dismissal are detailed on the 2 September 2026 page.
Boston Globe reports 2:45 p.m.: "It appears the jury has a question or statement."4 Boston Globe reports 3:33 p.m.: the court has a note from the jury.4
CBS Boston reports: "There was a lengthy and animated sidebar in the Lindsay Clancy murder trial in Massachusetts Thursday afternoon as deliberations surpassed 34 hours without a verdict."5 Boston Globe reports 3:00 p.m.: "Judge calls sidebar."4 CBS Boston reports: "Around 3 p.m. Thursday everybody was brought back into the courtroom and there was a long sidebar between the judge and attorneys."5 Boston Globe reports 3:22 p.m.: "Sidebar has ended"; "The sidebar ended after about 20 minutes."4
CBS Boston reports: "Defense attorney Kevin Reddington was expressive, waving his hands and gesturing toward Clancy during the sidebar, according to WBZ-TV's Kristina Rex, who was in the courtroom."5 Boston Globe reports 3:07 p.m. Shelley Murphy: "He has wheeled her wheelchair to the sidebar so Clancy can hear for herself what the judge has decided to tell jurors."4 CBS Boston reports: "At one point during the discussion, Reddington pushed Clancy's wheelchair up to the bench to join the conversation."5
Boston Globe reports, via Shelley Murphy 3:12–3:20 p.m.: each juror summoned, "sworn in," questioned under oath; "the last of the 12 jurors to be questioned."4 CBS Boston reports: "Each juror was then briefly called to the sidebar individually, with the judge appearing to ask them a single question."5 Boston Globe reports: "The alternates have not been called in."4
Boston Globe reports 3:28 p.m.: Sullivan re-instructed the jury on reasonable doubt. "I want to remind you that you are required to follow my instructions on the law," Sullivan said, repeating the definition of reasonable doubt and asking them to resume deliberations.4 Associated Press reports Sullivan said to the jury: "It is not enough for prosecutors to show a probability, or even a strong probability, of guilt,"6
After the jury left the courtroom, defense attorney Kevin Reddington moved to remove one juror. Boston Globe reports 3:32 p.m.: Reddington said the foreperson indicated "there's one juror" refusing to adhere to the law on reasonable doubt.4 CBS Boston reports Reddington said: "The question is not sufficient enough. It does not allow any foundation for a foundation to remove the juror who refuses to accept your instructions on the law, on reasonable doubt. If we come back in a half hour with a mistrial because of a juror that has just spurned the instructions of this court, it's a shame. It's a real shame," … "And that's why I object to the court's ruling, I request that we have further inquiry. My motion is to remove this juror that refuses to listen to your instruction on reasonable doubt."5
Boston Globe reports prosecutors objected to removal.4 Boston Globe reports 3:34 p.m. Travis Andersen: Sullivan said he was "specifically responding" to a specific question from jurors, and "the defendant's objection is noted, and we will be in recess on this at this time."4 Associated Press reports Sullivan said: "I don't think it's appropriate for me to say I agree with one juror or 11,"6 Associated Press reports the judge said "the defendant's objection is noted" and sent court into recess as deliberations continue.6
CBS Boston reports that following the exchange, Clancy was seen crying and leaning into Reddington.5
Boston Globe reports 4:10 p.m. Camilo Fonseca: "Judge William Sullivan excused the jurors until tomorrow morning for another day of deliberation."7 Boston Globe reports 4:18 p.m.: "Judge William Sullivan asked the parties if there was anything to address before Friday's deliberations. Despite the defense's strongly worded motion about the removal of a juror just a few minutes earlier, no points were brought up. The court then called a recess until tomorrow morning."7
CBS Boston reports, updated September 3, 2026 / 5:10 PM EDT: "A sixth day of jury deliberations in Lindsay Clancy's Massachusetts murder trial ended Thursday without a verdict."8 CBS Boston reports: "Jurors were sent home for the day just after 4 p.m., set to return Friday at 9 a.m. for a seventh day of deliberations."8
Boston Globe top summary reports: jury "has deliberated for more than 35 hours over six days."7 CBS Boston reports deliberations "surpassed 34 hours."5 WCVB reports, updated 5:15 PM EDT Sep 3, 2026: "The jury has deliberated for about 36 hours in the case."9
Associated Press reports, top: "The deadlocked jury in the Lindsay Clancy trial has gone home again without a verdict."10 Associated Press reports dismissal: "Remember the instructions I have given you over and over again," Sullivan told the jury, reminding them not to discuss the case with others or look at media coverage. The judge then excused them until Friday morning at 9 a.m., and declared the court in recess until then.10
After proceedings ended for the day, Reddington told reporters outside the courthouse he does not want a mistrial and there will be additional discussions over the juror issue to start the day Friday morning. CBS Boston reports Reddington said: "We'll have an argument about it. I don't think it'll be at the sidebar. I think it'll be in open court, which is my concern that we have arguments in open court, not at sidebar," … "Basically there's a person who has doubt but will not listen to the judge's instructions."8
Associated Press reports Reddington outside: "There will be an inquiry by the judge tomorrow at 9 o'clock," … "There's a person who has doubt but will not listen to the judge's instructions." Reddington on sidebar with Clancy: "She has a right to know what's going on."10
NBC News reports, updated Sept. 3, 2026, 5:09 PM EDT: "Following about 30 more minutes of deliberations, the jury was dismissed for the day shortly after 4 p.m."11 NBC News reports Reddington post-court: "I don't want a mistrial. Why would I want a mistrial? I kicked the s--- out of their case,"11 NBC News reports: "He added that the judge would have an inquiry regarding the lone holdout on Friday morning, but was unsure of the details. Reddington advocated for it to happen in open court." Reddington quote: "I want the public to know what's going on."11
Fox News Digital reports: "After court, Reddington revealed that a later jury note appeared to show an 11-to-1 divide."12 Fox News Digital reports Reddington quote: "When a note that the judge already has says that there are 11 jurors that have made a decision and one juror will not apply reasonable [doubt]..."12 Fox News Digital states: "The note does not reveal which verdict the 11 jurors favor or how the remaining juror is leaning."12
CNN reports: "Defense attorney Reddington — who believes the 11-1 split favors his client — objected..."13 CNN reports: "The jury note indicated they are split 11 to 1, and one juror "refuses to listen to the law" on reasonable doubt, according to Reddington."13 CNN reports: "The defense feels confident that the 11 are for acquittal and is concerned that a mistrial is coming due to the lone holdout."13
No mistrial declared. No verdict.12346578910111213
Contested
No verdict. No mistrial. Criminal responsibility remains contested. Defense motion to remove one juror denied; judge noted defendant's objection.
Reddington post-court claim of 11-to-1 split: Fox reports Reddington stated a jury note showed 11-to-1 divide.12 CNN characterizes Reddington as believing the 11-1 split favors his client and reports "the defense feels confident that the 11 are for acquittal."13 Fox states explicitly the note does not reveal which verdict the 11 favor or how the remaining juror is leaning.12 The split direction and acquittal interpretation are Reddington's claim and CNN's characterization of the defense position, not a court finding.
