What the record shows

Judge William Sullivan presided. Two witnesses testified: Dr. Avram Mack (forensic psychiatrist, cross-examination continuing from Friday) and Dr. Kirk Heilbrun (forensic psychologist, prosecution rebuttal).¹

Dr. Avram Mack testified on cross-examination. Mack diagnosed major depressive episode and major depressive disorder, not bipolar disorder. He testified Clancy retained "substantial capacity to appreciate the wrongfulness or criminality of her conduct." Mack stated postpartum psychosis is not a standalone DSM-5 diagnosis. Defense attorney Kevin Reddington conducted a combative cross-examination. Judge Sullivan interjected as Mack spoke over Reddington during questioning.¹

Dr. Kirk Heilbrun testified as the prosecution's rebuttal witness. Heilbrun is a professor at Drexel University. He spent approximately 180 hours on records review and evaluation, as reported by boston.com.¹² Heilbrun diagnosed bipolar II disorder.²³ He testified the diagnosis of record at Tewksbury Hospital is bipolar disorder.² He testified the evidence supported two possible explanations: altruistic filicide (killing children out of love so they would not suffer) versus acute psychosis with command hallucinations.³¹⁴ Heilbrun testified most evidence supported altruistic filicide.¹⁴ He expressed skepticism that the voice was heard only during the killings. He reported her first words to Patrick Clancy were "I tried to kill myself."¹

Heilbrun commented during testimony that Clancy was raised Catholic and offered his understanding of Catholic considerations. Reddington moved for a mistrial. Sullivan denied the motion.⁴ Sullivan instructed the jury to disregard references to religion and the witness's understanding of Catholic teachings. Sullivan dismissed jurors at 3:32 p.m.⁴ Heilbrun will resume testimony Tuesday. One more rebuttal witness will follow Heilbrun.¹

Contested

Whether she had bipolar disorder. Heilbrun diagnosed bipolar II; Mack diagnosed major depressive disorder.

Whether the evidence supports altruistic filicide or command hallucination. Heilbrun testified the evidence points toward altruistic filicide.

Whether postpartum psychosis is a diagnosis. Mack testified it is not a standalone DSM-5 diagnosis in his testimony.
