What the record shows

Dr. Paul Zeizel concluded his testimony. He testified Clancy still speaks about her children. "She really loves them and misses them and thinks of them every single day, almost every moment of the day," he said.¹

Zeizel testified he had spent about as much time evaluating Clancy as just one other defendant in his career as a defense expert. Defense attorney Kevin Reddington asked whether Clancy had continued to exhibit suicidal thoughts at Tewksbury Hospital. "She's in good hands at the moment, but there's always a concern that [suicidal ideation] sits directly below the surface," Zeizel said. The prosecution noted Clancy has not made any attempts at self-harm since January 2023.¹

Zeizel faced sharp cross-examination from prosecutor Shanan Buckingham, who suggested he was subject to confirmation bias in his assessment of Clancy. On redirect, Reddington refuted that assessment.¹

After the jury was excused, the court held a voir dire of Emily Thorndike, a licensed clinical social worker who worked at McLean Hospital from 2014 to 2021. Thorndike posted a TikTok video challenging the prosecution's claim that there were adequate staffing levels when Clancy was admitted to McLean. Clancy was admitted over New Year's Day weekend 2023, after Thorndike left McLean.¹

Thorndike testified she watched testimony in the trial before being sequestered, including Patrick Clancy's testimony. She said she posted the social media video about perceived inaccuracies in previous testimony. "I felt like what was discussed in court was not aligned with what my experience was," she said.¹

Thorndike said staffing ratios and procedures at McLean had not changed between her departure and when Clancy checked in. "From the records I reviewed, those are exactly the same staffing ratios, and all the groups are the same," she said. "No change whatsoever, not from what I can tell."¹

Thorndike said McLean guidelines discouraged providers from meeting with mental health patients for longer than 20 minutes "because you have other things to do." The prosecution asked whether Thorndike had personally reviewed any of Clancy's medical records from her visit to McLean. Thorndike said she had not.¹

Judge William Sullivan denied the defense's motion to call Thorndike as a witness. He suggested Thorndike's testimony had "limited materiality" to the trial. Because Thorndike had not worked at McLean for roughly a year before Clancy sought treatment there, Sullivan said there was a clear gap "between when she worked there and when the relevant time period is here." Sullivan allowed defense attorney Reddington to introduce McLean Hospital's staffing records into evidence.¹

After a lunch break, Sullivan excused jurors for the day, citing "an unforeseen circumstance." "This is not something we saw coming, but you're not to speculate about what it is," he said. "You're not to hold it against either side."¹

Testimony was expected to resume Thursday morning.¹

Contested

Whether Zeizel's extensive time with Clancy introduced confirmation bias in his evaluation, as the prosecution suggested.

Whether McLean Hospital's staffing levels and procedures in January 2023 were adequate for Clancy's needs.
