What the record shows

Opening statements occurred. Prosecutor Shanan Buckingham delivered the Commonwealth's opening. Defense attorney Kevin Reddington delivered the defense opening. Patrick Clancy, Lindsay Clancy's former husband and father of the three children, testified as the prosecution's first witness.¹²

Buckingham, prosecution opening: Lindsay Clancy "acted intentionally, rationally and swiftly." "This was not a woman in the throes of psychosis." "This is not a public debate about women's mental health and how the medical system treats women. This case is about this defendant, Lindsay Clancy."² The prosecution theory: she planned it, sent her husband out to run errands, strangled the children with exercise bands in the basement while he was gone.²¹

Reddington, defense opening: She had postpartum psychosis and bipolar disorder. Antidepressants after the third birth worsened her condition. "She loved those children right up to the time of their death." That day, Lindsay Clancy said she heard voices telling her, "This is your last chance. Kill the children so you can kill yourself," according to her lawyer.² The defense is lack of criminal responsibility.

Patrick Clancy testified. He found the children after returning from errands. A month before the killings, she described intrusive thoughts of harming them. He "never saw Lindsay harm the kids." After hospital discharge he was hopeful.²¹

Patrick Clancy, on Lindsay's mental health: she sought treatment for postpartum anxiety and depression. She was prescribed multiple psychiatric medications. A month before the killings she told him and her mother she had thoughts of harming the children.²¹

Patrick Clancy, on 24 January 2023: It was "one of her best days." She played with the children in the snow, built a snowman. He left the home. Lindsay Clancy remains paralyzed from the waist down after jumping from a second-story window.²¹

Patrick Clancy, GoFundMe statement 28 January 2023: asked the public to forgive her "as I have"; "The real Lindsay was generously loving and caring towards everyone - me, our kids, family, friends, and her patients."; "all I wish for her now is that she can somehow find peace."³⁴ These are his statements, not a campaign and not a medical finding.

The AP reports he has said in interviews he forgives her and viewed her as ill, not evil.²

Lindsay Clancy is charged with three counts of first-degree murder for the deaths of Cora (5), Dawson (3), and Callan (8 months). She has pleaded not guilty. The dispute is whether she is criminally responsible. The defense argues postpartum psychosis and that antidepressants after the third birth worsened her condition. If convicted of murder she faces life without parole. If found not criminally responsible she would be committed to a state mental-health facility.²

Whether she was psychotic: the defense says yes; the prosecution says no.

Whether antidepressants worsened her condition. Defense claim; not established as a finding.
