Formal Logic and Argumentation Theory: Foundations for Forensic Document Analysis
When an institutional document presents a conclusion, it implicitly claims that the conclusion follows from the evidence. This claim is logical in nature: given premises P1, P2, P3, conclusion C is warranted. Understanding the logical structure of arguments allows the analyst to assess whether conclusions are genuinely supported or merely asserted. This article presents the logical and argumentative foundations essential for forensic document analysis.
The Structure of Reasoning
Human reasoning takes three fundamental forms, each with distinct logical properties and appropriate applications.
Deductive Reasoning
Deductive reasoning moves from general premises to specific conclusions with logical necessity. When the premises are true and the argument is valid, the conclusion must be true.
Standard form:
- All A are B (Major premise)
- X is A (Minor premise)
- Therefore, X is B (Conclusion)
In institutional contexts, deductive arguments often take implicit forms. The statement "Dr. Smith violated his statutory duty to report" implies an unstated syllogism: all professionals who fail to report suspected abuse violate statutory duties; Dr. Smith failed to report; therefore Dr. Smith violated statutory duties.
The analyst's task is to reconstruct implicit deductive structures and assess their validity. Deductive validity concerns only the logical structure, not the truth of premises. An argument can be valid yet unsound if its premises are false. Copi and Cohen (2018) identify validity as the central concern of deductive logic: if an argument's form guarantees that true premises yield true conclusions, the argument is valid regardless of whether the premises are actually true.
Inductive Reasoning
Inductive reasoning moves from specific observations to general conclusions with probability rather than certainty.
Standard form:
- Observations O1, O2, O3... On all exhibit property P
- Therefore, probably, all cases of this type exhibit property P
Inductive arguments cannot guarantee their conclusions. The observation that all observed swans are white does not prove all swans are white. Inductive conclusions are always provisional, subject to revision upon new evidence (Salmon, 1966).
Weak inductive arguments pervade institutional documentation. A social worker who observes two interactions and concludes "parent consistently fails to engage" has made an inductive leap unsupported by the sample size. The analyst must identify such leaps and assess their reasonableness by asking: How many observations support the generalisation? How representative are the observations? Are there counter-observations?
Abductive Reasoning
Abductive reasoning, also called inference to the best explanation, moves from observations to the hypothesis that best explains them (Peirce, 1931-1958).
Standard form:
- Surprising fact F is observed
- If hypothesis H were true, F would be expected
- Therefore, probably, H is true
Abduction pervades professional assessment. A psychologist observes behaviours B1, B2, B3. These behaviours would be expected if diagnosis D were correct. Therefore, the psychologist concludes D. Lipton (2004) argues that abduction is the core of scientific reasoning: we accept hypotheses because they provide the best available explanation of observed phenomena.
The vulnerability of abductive reasoning lies in the phrase "best explanation." Best among what alternatives? Institutional actors frequently commit to explanations without adequately considering alternatives. The analyst must ask: What alternative hypotheses could explain the same observations? Were alternatives genuinely considered?

Formal Fallacies
Formal fallacies are errors in logical structure that render arguments invalid regardless of content.
Affirming the Consequent
Invalid form: If P then Q; Q; therefore P.
Example: If a child has been abused, the child may exhibit behavioural problems. This child exhibits behavioural problems. Therefore, this child has been abused.
The fallacy is evident upon reflection. Many conditions might produce behavioural problems. The presence of the consequent (behavioural problems) does not establish the antecedent (abuse). Yet institutional documents routinely commit this error, treating indicators as confirmations. This fallacy underlies many miscarriages of justice and child protection failures.
Denying the Antecedent
Invalid form: If P then Q; not P; therefore not Q.
Example: If parent is present during incidents, parent may be culpable. Parent was not present. Therefore, parent is not culpable.
The invalidity becomes clear: culpability might arise through other routes. Absence of one sufficient condition does not establish absence of the effect.
Undistributed Middle
Invalid form: All A are B; all C are B; therefore all A are C.
Example: All abusers deny accusations. This person denies accusations. Therefore, this person is an abuser.
The middle term (denies accusations) applies to abusers but also to innocent people. The conclusion does not follow. Yet this reasoning appears in institutional documents when denial is treated as confirmation of guilt.
Informal Fallacies
Informal fallacies are errors in reasoning that depend on content rather than logical form.
Ad Hominem
Attacking the person making an argument rather than the argument itself. The professional who dismisses parental concerns because the parent is "hostile" or "manipulative" commits this fallacy. The concern may be valid regardless of how it is expressed.
Walton (1998) notes that ad hominem arguments are not always fallacious. A witness's credibility is legitimately relevant to evaluating testimony. The fallacy occurs when character attacks substitute for substantive engagement with arguments.
Strawman
Misrepresenting an opponent's position to make it easier to attack. Parent says: "I am concerned that contact is being reduced without clear justification." Misrepresentation: "Parent demands unlimited unsupervised contact regardless of children's welfare." The strawman is refuted, but the original position remains unaddressed.
False Dilemma
Presenting only two options when more exist. "Either parent accepts our recommendations or parent does not prioritise child's welfare." The dilemma is false: parent might accept child's welfare as paramount while disagreeing about what recommendations serve that welfare.
Slippery Slope
Claiming that one step will inevitably lead to extreme consequences without demonstrating the causal chain. "If we allow unsupervised contact, the child will be at risk of abuse, will develop attachment disorders, and will ultimately require removal." Each link requires demonstration. As Walton (1992) observes, some slippery slope arguments are legitimate when causal connections are established, but most institutional uses are speculative.
Appeal to Authority
Treating authority as sufficient grounds for belief. The fallacy lies not in consulting authorities but in treating authority as proof. The analyst must ask: Is this person an authority on this specific question? What is the basis for their conclusion? Do other authorities disagree?
Circular Reasoning
Assuming the conclusion in the premises. "The assessment is reliable because it was conducted by a qualified professional, and qualified professionals conduct reliable assessments." The circularity may be disguised through complex document chains where Document A concludes X based on Document B's finding, while Document B's finding rests on Document A's conclusion.
Post Hoc Ergo Propter Hoc
Assuming that because B followed A, A caused B. "After the intervention, the child's behaviour improved, proving the intervention was effective." The temporal sequence does not establish causation. The improvement might have occurred without intervention or might result from other factors.
The Toulmin Model of Argumentation
Stephen Toulmin's The Uses of Argument (1958) presented a practical model for analysing real-world arguments. The model identifies six components:
Claim: The conclusion being advocated. "Parent poses risk to children."
Grounds: The evidence supporting the claim. "On two occasions, parent arrived intoxicated to contact sessions."
Warrant: The principle connecting grounds to claim. "Parents who arrive intoxicated demonstrate impaired judgment regarding child safety."
Backing: Support for the warrant itself. "Research indicates that intoxication impairs supervisory capacity."
Qualifier: The degree of certainty. "Parent probably poses risk" rather than "Parent definitely poses risk."
Rebuttal: Conditions under which the claim would not hold. "Unless the intoxication was a reaction to prescribed medication."
The Toulmin model is valuable because institutional arguments are rarely expressed in classical syllogistic form. They are embedded in narrative, with components implicit or scattered across documents.
Implicit Warrants
The most common analytical failure is leaving warrants implicit and unexamined.
Document states: "Parent has history of mental health treatment. Child should not be returned."
Implicit warrant: "Parents with mental health history are unsuitable carers."
The warrant, once articulated, is obviously problematic. It conflates mental health treatment (often a positive indicator of self-care) with parenting incapacity. Surfacing implicit warrants allows the analyst to challenge assumptions embedded in institutional reasoning.
Missing Rebuttals
Robust arguments anticipate and address counterarguments. Weak arguments ignore them. The absence of rebuttal suggests the author has not genuinely considered alternative explanations. The analyst should supply missing rebuttals and assess whether the conclusion survives.
Walton's Argumentation Schemes
Douglas Walton (1996) developed a comprehensive framework of argumentation schemes: recurring patterns of reasoning with associated critical questions.
Argument from Expert Opinion
Scheme: Source E is an expert in domain D; E asserts proposition A within domain D; therefore A is probably true.
Critical questions: Is E credible? Is E an expert in the relevant domain? Is A within E's expertise? Is A consistent with what other experts assert? Is E's assertion based on evidence?
Argument from Sign
Scheme: A is true in this situation; A is a sign of B; therefore B is probably true.
Critical questions: What is the strength of the correlation between A and B? Are there other explanations for A? Is B the best explanation for A?
This scheme underlies diagnostic reasoning. The critical questions prevent over-interpretation: bruising might indicate abuse, but it might indicate normal childhood activity or medical conditions.
Argument from Consequences
Scheme: If action A is performed, consequence C will occur; C is undesirable; therefore A should not be performed.
Critical questions: How likely is C if A is performed? What evidence supports the causal claim? Are there other consequences to consider? Are there alternative actions?
Child protection reasoning relies heavily on consequence arguments. The critical questions challenge speculative consequence chains and demand consideration of the consequences of intervention itself.
Walton, Reed, and Macagno (2008) catalogue over sixty argumentation schemes with associated critical questions.
Application to Forensic Document Analysis
Reconstructing Arguments
Institutional documents present conclusions embedded in narrative. The analyst must:
- Identify the conclusion: What is ultimately being claimed?
- Extract the premises: What observations or assertions support the conclusion?
- Reconstruct the logical form: What type of reasoning connects premises to conclusion?
- Identify implicit premises: What unstated assumptions are necessary?
- Test validity: Does the conclusion follow from the premises?
- Assess soundness: Are the premises true?
Fallacy Detection
Armed with fallacy taxonomy, the analyst can identify formal fallacies (invalid logical structure), informal fallacies (substantive reasoning errors), and rhetorical manipulation (arguments designed to persuade rather than demonstrate).

ANCHOR Phase: Origin Quality Assessment
The ANCHOR phase traces claims to their origins. Logical analysis assesses origin quality: What type of reasoning produced the original claim? What fallacies may have infected the original reasoning? What argumentation scheme was employed, and does it survive critical questions?
A claim originating in affirming the consequent ("symptoms present, therefore abuse occurred") is weaker than one originating in careful differential diagnosis.
INHERIT Phase: Propagation Without Verification
The INHERIT phase tracks how claims propagate. Logical analysis identifies whether receiving documents assess the logical quality of inherited claims, whether propagation introduces new fallacies, and whether critical questions go unasked at each inheritance step.
For expert opinion claims, inheritance should involve assessing the expert's credentials, domain, and evidentiary basis. Unverified inheritance simply repeats the claim without engaging these critical questions.
COMPOUND Phase: Authority Accumulation
The COMPOUND phase examines how claims gain spurious authority. Logical analysis reveals appeal to authority fallacies (treating institutional endorsement as proof), circular reasoning (mutual citation creating false appearance of independent support), and composition fallacies (treating accumulated weak claims as strong overall case).
The Toulmin model is particularly valuable here. Qualifiers ("possibly," "may") should remain stable unless new backing justifies increased certainty. When qualifiers disappear without new evidence, the analyst identifies modality shift through argumentation analysis.
ARRIVE Phase: Outcome Causation
The ARRIVE phase connects document chain failures to harmful outcomes. Logical analysis supports causal reasoning assessment (identifying post hoc fallacies), counterfactual analysis (what would have followed from sound reasoning?), and consequence argument evaluation (were predicted consequences warranted?).

Practical Applications
Legal Proceedings: Argumentation analysis supports cross-examination (exposing fallacies in expert testimony), written submissions (reconstructing and challenging opposing arguments), and appeals (demonstrating that findings rest on fallacious reasoning).
Regulatory Complaints: Logical analysis strengthens complaints by demonstrating specific reasoning failures, classifying errors using recognised fallacy categories, and showing how conclusions do not follow from evidence.
Professional Standards: Professional bodies require reasoned decision-making. Argumentation analysis can demonstrate failure to apply appropriate reasoning standards and reliance on invalid inference patterns.
Limitations
Logical validity does not guarantee truth. Sound premises can be contested on grounds other than logic. Arguments that are fallacious in one context may be legitimate in another. Reconstructing implicit arguments involves interpretation, and different analysts might reconstruct the same document differently.
Conclusion
Formal logic and argumentation theory provide essential tools for forensic document analysis. By understanding deductive, inductive, and abductive reasoning, analysts can assess whether conclusions genuinely follow from evidence. By recognising fallacies, analysts can identify specific reasoning failures. By applying Toulmin's model and Walton's schemes, analysts can systematically reconstruct and evaluate institutional arguments.
These tools do not replace professional judgment, but they discipline it. The analyst who asks "what type of reasoning is this?" and "does it survive critical questions?" brings rigour to what might otherwise be impressionistic criticism.
Institutional documents claim logical authority: they present conclusions as following from evidence, assessments as warranted by observations, recommendations as justified by analysis. The logical tools presented here enable the analyst to test these claims, distinguishing genuine support from mere assertion.
As Johnson and Blair (2006) observe, argument evaluation is a practical skill developed through application. The philosopher's question remains central: "What follows from what?" The analyst's task is to determine whether institutional assertions of logical support are actually true.
